Problems upgrading my phone after trust deed

Hi I entered into a trust deed in 2013 and was discharged in 2016. During this time I was able to upgrade my mobile staying with the same provider. I have tried to upgrade now and they are saying I am unable to. Whilst not being able to tell me specifically why I can't upgrade one advisor suggested if I had been made bankrupt in the last two years (since I last upgraded) then this would prevent me being able to. I have checked my credit report and the trust deed is noted under insolvencies as it should be. My question is when would my trustee have reported the trust deed? If it was right at the start then would have been on file prior to my last upgrade if it was after my discharge then that would explain my mobile phone companies change of stance.

Hi Lewbowski33.

As I understand it, the credit reference agencies are reporting information obtained from the official insolvency registers rather than directly from trustees.

I'd imagine the key dates are when you signed the trust deed and when you were discharged from it.

Company policies in respect of credit history can and do change over time.

I signed the trust deed in april 2013 and was discharged in September 2016. The dates on my credit file are correct. I was just a bit confused because like I said they had let me upgrade during the trust deed, they even said that because I was already with them they wouldn't do a credit check. I guess they must have changed their policy. Oh well at least the phone I've got still works! Thanks for your reply.

You do of course have the option to see if other phone providers would be more welcoming of your business.

Hi Lebowski33,

We don’t notify or correspond with the credit reference agencies. As TDA has advised they will probably have picked up this information from other sources such as the Register of Insolvencies.

It’s a good idea to shop around as other provides might be happy to give you a new contract.

Let us know how you get on if you do shop around and are successful.

Thanks for your replies. I was just a bit confused as they have let me upgrade twice iwhilst my trust deed had been running. Unfortunately at the moment I'm not able to move to another provider as the contract I'm in allows me to upgrade early but if I want to leave I need to pay up the rest of my contract. It's no big deal as my phone works, I just saw a good offer and wanted to take advantage of it. I'll wait till my contract is up then shop around.

Ah ok.

Have you thought about selling your current handset? This could be worth enough that you could sell this, use the funds to pay off your remaining contract and move to another provider.

I used to do something similar but our oldest is now at an age whereby he is asking for a mobile phone. My contract us up shortly and I’m looking at a new phone. My wife suggested we use my old phone as a present for our oldest for his Christmas as it’s still in excellent condition.
