Just got a letter from Capital One saying they are going to offsete my PPI claim against any money i owed them and if anything left would be sent to IP. Was discharged in 2010. Anyone else had an issue with Capital One

Hi sophie.

I'm not sure that this will turn out to be an issue.

I suspect Capital One are referring to any money currently owed to them. We've not heard of them referring to money previously written off in trust deeds before (that's just RBS and NRAM to our knowledge).

I'd imagine your former trustee will confirm that they have no interest in the funds and that they'll then send them to you.

Please let us know how this plays out. It might take a little while.

Ah... sorry I had missed that.

So the issue here is what Mr Mond chooses to do, rather than Capital One?

Please let us know what happens from here. It will be very interesting to see the course of action chosen.

Hi,

Sorry Mr Mond does not have the money, Capital one are reviewing how much they lost when i went into the trust deed and if there is anything left they will send it to Mr Mond. Same as the issue with RBS.

OK.

We've only heard about this happening at RBS and NRAM before.

Please let us know if Capital One does try to set-off written-off trust deed debt. It won't be clear until final figures are presented.

Capital One did this to me some months back. Itโ€™s currently with the ombudsman.
