ppi refund after trust deed has ended

hi i was in a protected trust deed a few years back which has since finished , i recently tried claiming back ppi from rbs and after the financial services ombudsmen upheld my complaint the rbs paid the refund to a credit card that i assumed would have been cancelled when my trust deed was discharged, do i have any recourse to claim the money that was giving by the bank and if so any advice on my next move would be appreciated.

Hi grahamslife and welcome.

RBS have adopted a position that they can set-off PPI claims against old debts that were included in protected trust deeds.

We haven't heard that this position has been tested legally.

Are RBS doing this in all cases, to your knowledge?

I was discharged from my trust deed in July, and at the same time my husband had a successful PPI redress from Barclays. I hadn't even thought about trying previously.

I applied in August and they say they will send a decision by 10 October.

Obviously, I see how they have a legal and moral right to retain money that I haven't repaid, but it would be nice to get some! I only owed 10 more months of my loan to RBS, so it's possible there might be a dot left over anyway.

I wish I could tell you otherwise, but I think it's hugely unlikely you'll get any PPI money from RBS I'm afraid.

that's what I figured, to be honest. I have read that they give the statutory interest back, but will just have to wait and see!

Will update when I have an answer.
