hi looking for some advice,i completed my protected trustdeed april 2015,and was discharged (form 5)December 2015.i was told by my trustdeed company that as I had been discharged that was end of it and was free I asked them about ppi as my wife had looked into it but was in joint names they said yes can claim and keep money even said if I won lottery I would keep all money,since then it turned out I had ppi and bank contacted them now td say money has to go to them also td name on all my letters it not same as on aib register is that normal thanks any advice would be helpfull

Welcome to the forum misha1.

Has your trustee been discharged?

This happens after your discharge and can be reviewed on the online Register of Insolvencies (via the Accountant in Bankruptcy's website).

I'm not sure why there would be different trustee details on letterhead and the AIB register. You could check with your trustee or the AIB to try to understand why that is.

No my I've found out my trustee hasn't been discharged yet as this new ppi has come to light it was myself that told them as the bank needs them to sign payment forms just called Td and apparently trustee who discharged me has left and trustee on the aib site is a new one should they have notified me of this change?also they sent me a ppi cheque in January when I asked why was told as I had been discharged all money would come back to me now (£130) now it has has come to light ppi is around the (£12,000) mark they say I can't have it as all money ie windfalls ppi lottery inheritance has to be given to them? This ppi wasn't anything to do with accounts to what my debt was for also although these loans and credit cards were in my name my wife paid half of this money to me to pay is she entitled to money back also it says on aib web site aib7 trust deeds page 4 it states that my creditors have to discharge the trustee before I can be discharged is this right or wrong?

I have spoken to my Td again tonight this adviser has said that they have had a phone conversation with rbs and they are waiting for them to amuse what I owed them they apparently have all the information for the ppi claims I have with them which amount to £29.04 they haven't got a clue as these ppi claims are sitting at £12,000 just now and may go up still.i have spoke to a line manager in supervisory team and logged an official complaint not sure anything will happen or what should happen is there any steps to take after this,from day one of trust deed I have to call them to find information out I even paid 2 payments to my 36 month plan that they initially said wasn't showing definitely think I went with wrong company

I'm afraid that it is entirely normal for PPI payments made prior to a trustee's discharge to be paid into a trust deed. In some instances at the moment this is even happening after a trustee has been discharged. You really shouldn't have been told otherwise previously.

It's not relevant that the PPI relates to accounts that weren't included in your trust deed. What's relevant is that this was an asset (the potential to claim) when you signed your trust deed.

I'm afraid if your wife is not named on the account to which the PPI relates I can't see that any of the money will go to her.

There seems to be a misunderstanding regarding the discharge of your trustee. They apply for their own discharge and it can only happen after yours.

Hi misha1,

Unfortunately as TDA has advised if your Trustee is still in office then they will look to automatically recover any PPI funds.

Even if your Trustee was discharged they could still lay claim to the PPI funds and it would be up to a sheriff to decide this. This is a hot topic at the moment for many people.

It does sound like there has been a miscommunication somewhere along the lines and I'm sorry it's not better news regarding the funds.

Miscommunication or misinformation?

For example, once a trustee is discharged they cannot lay claim to a windfall like a lottery win. Looks like Misha1 has been miss-communicated about this as well.
