Question.
Let’s say we have 12 people. Who were in a trust deed. Say 10 years ago. In last year banks been. Refunding ppi. And these 12 people all due refund for misellin.However. Different banks dealing with. Payments differentlyt. 6 sent payment direct to former customer and 6 to former trustee.
So. Has public just to accept. It’s just the luck of the draw
Thanks What’s everyone’s thoughts on this

Not long to go now, and we should hopefully have some answers!

I am one of the ones that got the PPI, but in a few months of madness decided to spend most of it.
I'm now in a state of permanent anxiety in case Mond wins, and the bank or my trustee demand the cash back.

I wish that my trustee had intercepted the cash first, and held it in limbo until the outcome.

Surely. They can’t do that ask for it back ? A costly thing chasing up former debtors from so long ago. Not the debtors error surely

That was my logic when spending it Wildchild….regret it now though!

I have found the whole PPI/Mond thing so much more stressful than my entire Trust Deed.

Fingers crossed for all of you still can't believe that it could reopen some trust deeds if Mr mond wins case should not be allowed question is what would the rest of the trustee take will some try and reopen some trust deeds we don't know until after the court case you never know he might loose Mr mond must have very deep pockets I hope they end up empty

Amor. Banks error then. They made mistake up to them to pay trustee if it comes to this surely

Trustee forget that people lives is involved here not just money if mond wins does that mean the trust deed was not wort the paper they was writing on

That's exactly what is being decided by the Court though.

If PPI was not ingathered, was the contract fulfilled given that part of that contract is the realisation of assets?

It is not as easy an argument as you present, hence the protracted Court procedures.

Wrongly sold ppi possibly wasn’t around. When some people were in trust deeds don’t seem fair at all and surely up to a trustee to sort this at time not say many many years later

Not if the banks unreasonably refused to pay out. As happened a lot.

Anyway, this subject always arouses very strong feelings. Understandably.

It’s enormously complex though. That’s why lawyers and judges have kept coming to different conclusions.

My old TD company decided that after the second CoS verdict against Mond, they no longer were taking an interest in PPI payments and the bank sent the funds to me in their instruction.

I can’t see how if Mond wins this appeal they can then ask for it back, I have it in writing that they declared no interest in the funds.

Good luck to them if they tried to though.

I can't see trustees reopening trust deeds just for the sake of it if mond wins unless they know you have claimed a very big ppi claimingit would not be worth there while otherwise my very old trustee told me he will not be looking into reopen my trust deed costs to much to reopen it and it to do with the wording of trust deed .I have my fingers crossed for those on hear waiting for the outcome
