Hi jojo93.
They could go looking if they chose to.
I can’t see why it would be of interest to them if you’ve been discharged a long time ago.
They’re already perfectly entitled to ask if you’ve ever been in a trust deed as part of any credit application.
Thank you tda when I signed my trust deed all those years ago there wasn't any sites like this you could ask for help
Tda going back to your earlier point about fairness to creditors when I signed my trust deed this ppi Thing wasn't even thought about I agree that the money should not go to the debtor which is why I am not claiming ppi I am objection that my trustee could reopen my trust deed after all these years to see if I have ppi it is done and dusted different if it was a new trust deed

What’s in question is whether the creditors should benefit from an asset that was present when the trust deed began. A debtor makes such assets available to their creditors, and the creditors accept the trust deed on that basis.
Why should they lose out at no fault of their own?
I would be quite happy if all the money went back to the creditors but when you look at ppi company taken 30% then trustee taken there cutWould you consider it fair if a mechanism existed for the creditors to benefit from this money without a trust deed being reopened?
If mond wins his case can your trustee still be able to claim ppi and reopen your case after the ppi deadline of 29 August next year also if the trustee checks to see if you had ppi will it be for the debts included in trust deed or will they be claiming for ppi for debts that you had years ago and are paid
Hi jojo93.
I don't think trustees will speculatively reopen trust deeds if Mond wins this case.
I think they'd have to consider applying to the Court to do this in the event that they became aware (usually because a bank made them aware) that a PPI award was to be made. They might also consider it if they're aware of a case they managed where banks originally turned down a PPI claim and it's since become clear that they shouldn't have done so.
It's not relevant whether a PPI claim relates to a debt that was in the trust deed. It's the fact that money could have been claimed to help repay the creditors.
Of course, it's quite possible that Mond will lose.
Will the trustees still be able to claim ppi after the dead line next year the court case could take months if he wins some trustee s might not have enough time to claim ppi
Why else would former trustees hold on to ppi monies til after mond if it wasn't to re open td ? Just took it that why they not paying out
Something to look forward to .. not !! Re living what happened nearly 15 years ago
So if mond wins the trustees will need Togo to court quick to get the trust deeds reopened before the deadline
I also did I trust deed 20 years ago I was discharged I contacted the trust deed company I dealt with at the time they told me all records of my trust deed was destroyed I did another trust deed 14 years ago and was discharged if my last trustee would to check to see if I had ppi would he be able to claim ppi that was connected to the debts of my first trust deed I doubt my first trust deed would be reopened if all the records was destroyed
