i was discharged from my trust deed in 2007 the trustee was as well i have read that trustees are reopening trust deeds to claim ppi i dont want to make a claim for ppi i just wanted to know could the trustee reopen my trust deed to make a claim for ppi after all these years its not the money i just dont want my name on the register of insolvencies again .

Hi JoJo

There is a court case to be heard summer 2018 that will provide further guidance on this matter.

The deadline for PPI is 29 August 2019.

Perhaps it may be best to wait until decision has been made before claiming PPI but please be mindful of the deadline to claim.

If the trustee made a claim for PPI, the lender would inform you as well.

when is the court case if a trustee reopens a trust deed that means your name will appear in the ROI so that would show up on your credit file would we still remain discharged

Hi jojo93.

A trustee would (if they were allowed to) have to seek the permission of the Court to re-open a trust deed.

You would remain discharged at all times if the Court allowed this to happen. There would be no new credit report entry.

I don't know the specific date, but I understand the action on this matter will continue later in the summer.

thanks TDA for that i was worried in case it showed on my credit file i have applied for some jobs and some of them you get vetted and they do a credit check

I don't think there's any issue in that case jojo93.

Given your trust deed is so old I doubt it would happen even if it could.

when i trust deed gets reopened your name appears in roi does it appear in the Einburgh gazette as well

That's the old way of "advertising" a trust deed jojo93.

It's not used any longer.
