Hope someone can help with this. I am currently considering a PPI claim against Next Directory. The data access form asks if I am insolvent or bankrupt so does this mean that they will pay any money due directly to my trustee? The Next account is not part of my TD as it was all paid up and closed a few years ago.

Hi wr2406,

If you are still subject to your Trust Deed then any sucsssful PPI should be paid into your Trust Deed unfortunately.

It doesn’t matter that the Next account isn’t a debt in your Trust Deed it’s because it’s a potential asset which can benefit the creditors.

Your Trustee will look into this if they haven’t already so it will probably come to light at some point.

Hi David thanks for the reply.

I thought this would be the case. When I signed my TD I got a letter from a company asking for permission to check for PPI on my behalf and as far as I'm aware they found none. Would this mean then that they have already looked into it?

It does sound like it but you would need to check with your Trustee.

When PPI first came around a number of years ago we appointed a PPI specialist to review our cases and investigate PPI. We are now taking a second look at our cases as in some we were advised there was no PPI at first and now the second company has successfully found PPI and recovered this.

How long do you have left on your Trust Deed?

Hi David

I still have 3 years of my TD left. When I received the data access forms they only included the credit cards that are a part of my TD

The PPI is something which will form part of your Trust Deed.

What makes you think your Next account might have PPI?

I think if you do look to submit a claim to Next if you are sucsssful then likelihood is Next will pay the funds directly to your Trustee. If they don’t and pay it to you then you have an obligation to notify your Trustee. If you were to spend the money it could have serious consequences for your Trust Deed.

Hi David

I'm not sure if my Next account had PPI I'm in the process of finding out if it did. I have informed them of my TD but if they pay the money to me, rest assured my Trustee will receive every penny
