Looking for some advice folks.
My wife had a trust deed from 2010 until being discharged back in April 2014. Her trustee had done ppi checks before discharge all okay.
Last year she had filled in a free ppi check online, subsequently she received word back from rbs she had been successful with 4 claims and was due back over 4k
But as rbs were one of the debtors on the trust deed they are now keep all of the claim.
Now my wife is receiving threatening letters from Allay demanding she pays them the 20% fee for the successful claims.
Does anyone have any advice on what can be done regarding this? As it stands it's looking like we will be several thousand pounds worth of debt for literally doing nothing.
Hi GrangeLachie,
I'm afraid I don't think we're going to have very good news for you on this (for now at least). As I'm sure you've read elsewhere here, RBS aren't paying out PPI claims where they'd previously written off debt via a trust deed.
This may change in the future because there is ongoing legal action.
Did Allay provide you with any risk warnings or advice about the RBS position on PPI after trust deeds? Did you may them aware about the previous trust deed?
My wife wasn't aware of any risk warnings, but Allay are saying it's in the small print and my wife will no be liable to pay them even though we haven't received a penny from rbs.
I guess you could argue that they really should have made you aware of the particular risk regarding RBS and trust deeds.
You could perhaps also argue that they do not demand payment of the fees until the legal action has run its course.
Ultimately I guess this is a legal contractual matter between your wife and the claims firm. If you dispute that the fees are due, you may wish to contact a solicitor or legal advice centre.
To be honest I think it was one of those things you really just don't think fully about or read the small print.
Rbs Ppi team have sent the payment to the debit management team. They won't give Allay a penny so it's looking like we're just gonna have to pay Allay up god knows how as my wife is on maternity just now.
Spoke to rbs debit management team who have told me they have retained funds and allocated the funds to an old debit.
I did mention about the case rbs vs donnelly but the advisor was unaware of the case.
