Do my trustees have the right to contact me re PPI after the trust deed is complete and discharged??

Hello Heather1 and welcome.

Have both you and your trustee been discharged from the trust deed?

Do you have any objection to PPI claims being used to help repay your creditors if it's possible for that to happen?

I do now - surely this should have been dealt with when deed was active. Do I need to answer any further questions from my trustee regarding this

But have both you and your trustee been formally discharged Heather1?

Some trustees are remaining "in office" to handle PPI claims even after they have discharged their client. This means that they have not been discharged.

The alternative would be to refuse to discharge you until after all PPI claims are completed (as some firms are doing to the understandable frustration of some of our members).

If your trustee has remained in office for this purpose they may well have the right to expect some assistance from you I'm afraid.

I recieved a letter in November saying my trust deed had ended and to stop the standing order - there was no mention of them staying 'in office' and no mention of this in my trust deed. also if it is misold insurance surely that would not form part of the debt as I should not have had in the first place - though it was all about returning you to the position you would have been in had you not had this?? My really query though is whether they can do this if I am discharged and no mentionof them staing 'in office'

One way of checking if your Trustee is still in office is to look at the AIB government www easy to find on google.
If you don't have an account it is again easy to set up one for yourself.
Once you look at your entry, it will show if your Trustee is discharged or not.

That's great - I did it and there is nothing there at all - would that mean I am dscharged??

Have you actually checked on the Register of Insolvencies, Heather?

If you go to the AiB website, there's a box on the top right hand corner of the site, which says 'Register of Insolvencies'.

Click on that, follow the intructions, then search for your name.

If you only got your letter in November 2012, there should still be a record of your trust deed on the Register. It only comes off a year after your trustee is discharged.

Of course, if you got that letter in November 2011, and you've already checked the Register, it sounds as if your trustee probably isdischarged after all!

Date of trustee's discharge 04/01/2013
Date of debtor's discharge 25/09/2012

The above is a copy of my file, shows when I and my trustee were discharged. It should have a date against debtors discharge. Are you saying that you are not there? What's blank?

Perhaps someone will advise if it's possible that you were not listing on the AIB at all!

Thanks for your help. I did recheck and I am still there. What else happens when you are discharged - I received a letter in Nov showing all the payments and anotherletter to say that was it and to cancel the standing order - 3 months ago. Today the trustee contacted me re ppi - my original query was do I still have to speak to them and give them information - after 3 years thought i was all over and just wanted to move on so not really wanting to engage with them anymore if I don't have to

How would I know that - other than the letters I received beg November heard nothing else from them until today re ppi

Heather, there are (at least) three stages to ending a trust deed.

- making your final payment, and being told to cancel your direct debit

- getting a letter/form from your trustee which tells you that you have been personally discharged from the trust deed

- getting a letter/form from your trustee which tells you that the trustee is discharged

Your trust deed doesn't completely finish until your trustee is discharged.

All we know for sure, from what you have told us, is that you have made your final payment.

Go back onto the Register of Insolvencies, and check your entry again.

It will give your personal details (name, address etc); your trustee's details (name/address etc).

Then it gives the 'deed details'. The date the TD was signed, date it became protected and so on.

In that section, look for 'date of trustee's discharge' and 'date of debtor's discharge'.

If they're blank, your trust deed hasn't finished, and you should really speak to your trustee as soon as possible.

Thanks candlewick that was really helpful - it looks lik I am not discharged then - ho long does it take because that been 3 months since I made the last payment? I will attempt to speak to them on Monday although they not very good at answering e-mail/phone!!
