My last post was an excited one about finishing my DAS, and so far it has been great receiving statements with zero owing on them. Most of my creditors so far seem to have updated their records. However, Next Directory have continued to be one of the worst to deal with! I received a statement from them in December, with a balance owing and a payment amount to be made. I got in touch with my adviser, who said it may take time to update. So, I left it.
I received a statement last week, a red one, saying that I hadn't made my minimum payment...... So I called them, explained that my DAS had ended and that I didn't believe I owed them any money and they said that they would look into it. A few days later, I got a letter with a payment plan for 6 months on it. So, I called them again and they say that they have never received any notification that my DAS is finished. Incidentally, I have gone through all my old emails about Next, and the woman I spoke to the other day is the same one I complained about previously - her manner was quite rude stating that I "must pay or they would pass my debt on to a collection agency"!!! (she has an uncommon name, and it rang a bell!)
So, I have emailed my adviser, but I'm not sure how much longer I can keep doing this, as I was told that they no longer have the authority to act on my behalf. I can feel all the worry I had before coming back as I really felt like I was banging my head against a brick wall with them when my DAS started. Every time I tried to deal with it, they just kept demanding that I pay them money and didn't seem to be prepared to listen to understand what I was trying to explain!
I can only wait until my adviser emails me back, but I was wondering if anyone had any advice post-conclusion of an Arrangement? What happens if my adviser is no longer able to help me - where do I turn?

First - congratulations on finishing your DAS!

Second, Next are out of order.

Give them a chance/enough rope to hang themselves and ask your payments distributor if they can send Next another copy of the letter confirming your DAS has completed. Ask them for a copy for yourself too.

If that stops Next hassling you, job done [:)]

If they keep hassling you, send them a formal complaint, enclosing a copy of the payment distributor's letter and pointing out that this is the third copy they've been sent and it is unacceptable for them to still be pursuing you.

Firewalker has made a lot of very helpful posts about how to complain to creditors who haven't updated credit reports - you might find some ideas for your complaint letter in those posts [:)]

With a bit of luck, and some commonsense from Next, it won't come to making a complaint - but do remember that you have the option, and the right, to make a complaint if Next keep acting like this.

Brilliant. Thanks! I guess I feel a bit lost as my adviser has done all they are meant to do and Next really have been a pain from the beginning. I'll check out the info from Firewalker.

Hi scared11.

You've had some excellent advice from candlewick already.

The only thing I'd add is that there's no need to feel too stressed about this, even though I can totally understand why you might do.

If you've successfully completed your DAS which covered that Next debt there is literally nothing they can do. They can say what they want, write what they want, pass your "debt" to whoever they want, but the debt simply doesn't exist so nothing really bad can happen to you. They're wasting their time and money.

The only real reasons to address this are for the benefit of your credit file and to avoid hassle - both of which are important of course.

I was having trouble with an rbs default a few months back and my financial advisor told me to not bother with anymore letters and phone calls. He told me to go on to their Facebook page and complain as they hate negative posts. So after doing this it was sorted out really quickly for me so I would advise doing the same thing to next. Obviously don't tell them everything in the Facebook post, just say something like " really disappointed in next"

Just been contacted by my adviser, and they are going to get in touch with them. She told me now to accept any nonsense from them and absolutely not to pay them any money as I don't owe them it. She seemed very positive! Fingers crossed.

Just to echo what others have said this isn’t something you should worry about and as your advisor has said take no nonsense from them.

If it comes to it don’t hesitate to submit a formal complaint to Next.
