Hi i'm new to the forum and am looking for a bit of information. I started my trust deed back in 2008 and have fully paid my contributions (according to my breakdown of contributions i actually paid more than the initital estimates),my final payment was in May. I have had massive issues with the communication of the company, after numerous phonecalls and letters i decided to make a complaint to the ombudsman, from which i got quick replies from all parties. Today i have recieved a letter (paraphrased) -

' i write to confirm that you have been discharged of your obligations under the terms of your trust deed per paragraph 14(2)(b)
However at present I am unable to initiate the procedures to finalise your trust deed administration until i have concluded my investigation into whether or not you have been mis-sold PPI policies. Thereafter i will be in a position to finalise the trust deed administration.
Please regard this letter as your notice of personal discharge'

i have tried to telephone the trust deed team several times today and it is now going straight to a pre-recorded message. I dont leave messages anymore as they are never returned.
I was hoping someone could let me know if this means i can now apply for a current account with my bank? and if i will be able to start building my credit rating in the near future?

Many thanks
Sarah

Your problems with your IP sounds very familiar, I wonder if they are based on West George Street in Glasgow.....

Any way, you could have applied for a current account anywhere, acceptance is up to the Bank you go to. Try Barclays Cash Card account, you get a Visa debit and pay DD's from it.

With regards to your complaint, NO PRESSURE!!!! but would you be willing to share who you complained to it sounds like you got a good result so it would be worth sharing with others who are having similar problems.

Regards

Ha yes PingPong it was the very same company, i've heard a few stories regarding them also πŸ˜‰

My sister works in financial services so i asked her and she advised me to go straight to the top so i researched and sent my complaints letter to Julian Walker, the head of FSA compliance in the UK. I sent the company in question a copy of the letter and sent it recorded delivery. i have had corrospondence from both parties after the inital complaint and contact numbers for senior staff in the company. So within a month i have had the 'personal discharge' letter where before i was waiting for five months for any information.

Thanks for your info regarding the bank accounts, much appreciated πŸ™‚

Welcome to the forum Sarah1983.

As pingpong has suggested there is no reason why you cannot apply for a current account. As your discharge is so recent some banks may be wary about offering you credit so it's probably best to avoid applications for accounts with overdrafts if simply getting the account is the most important thing to you.

It sounds as though your trustee isn't going to be discharged yet so that they can carry on trying to raise more money for your creditors via PPI claims (if possible). That shouldn't mean that you cannot start making sure your credit file appears as it should do though.

The following article might be a useful starting point:

Congratulations on your persistence about getting discharged.

Thanks trust deed assistant πŸ™‚

I read the article and am keen to do all i can to start the process in finding out how my credit file looks at the moment. Would i simply join one of the websites, such as experian and go from there? is there someone specific to write to about the default notices?

I think the three main credit reference agencies all offer free trials of their services via their websites Sarah1983. They're Experian (CreditExpert), Equifax and CallCredit.

You can access the CreditExpert trial from this site at:

(Updated 2020 - Links to free credit report versions can be found at: https://www.trust-deed.co.uk/repair-your-credit-rating.html).

You might want to give it a little time so that your creditors have an opportunity to update your credit record. However, any that do not will need to be written to (or called) directly.
