Hi I have received a letter from my work saying my job is terminated on the 19th of september. My last payslip will be next week. I am getting 6 weeks payment in lieu and 11 and a half days holidays. My esa has not stated yet. What happens with that money do the trusted deed take it all?
Thanks
Thanks for your post and I am very sorry to hear that you has been notified of this.
You would be best to forward correspondence setting out your entitle my to your Trustee. They will then inform you in writing of what you may keep and what the creditors are entitled to.
For information you are entitled to all statutory elements which would be arrears of wages, pay in lieu of notice, and holiday pay. Any other elements are usually paid to the Trustee.
Rob is not currently posting in the Trust-Deed.co.uk forum.
Thank you for your advice I hope this works out. I am worried I would not have enough to live on till my esa kicks in.
Thanks
Hi Rob
Your response that holiday pay & pay in lieu of notice being 'statutory' is interesting. When I was made redundant at the end of July I had to hand over all holiday pay and pay in lieu of notice! I was only allowed to keep the 'statutory redundancy@ payment. I tried to argue that the pay in lieu of notice was salary to no effect.
