Partners trust deed having an effect...HELP

I will try and keep this as simple as possible!
Last year my partner finally admitted defeat and sought help for his debt issues. He found a Trustdeed, we set up separate bank accounts and all seemed fine.
He had credit cards, loans and an overdraft with TSB as well as a single account and a joint account with myself. The cards, loans and the overdraft account all went into the trustdeed and as far as we know the single and our joint one was closed. However I have recently out of curiosity had a look on Experian to check my credit rating and I was horrified to see it was poor due to a default account with TSB, on further investigation it seems our joint account was not closed and they have continued charging us for its use which has put it into an unplanned OD. When I have tried to pay this they said as it is in the trust deed we cant pay it off yet they will still continue to charge us! How can this be allowed? I have had no letters from them or anything telling me of this OD and now due to it my credit rating is affected with no way of me sorting it as they wont allow me to pay the debt off. Advice/help please!!

Welcome to the forum caz184.

If you're not in a trust deed you can pay the joint account off. I cannot see how TSB can refuse a payment, nor why they would do so. I think someone you've spoken to there has got the wrong end of the stick.

I'd pay the money in online to clear it, or you could go into a branch to do this. Once that's done you'll want to follow up to ensure that the account has been closed.

Also as you seem confident that it was closed then it is time to complain.

In your complaint, explain to them that you are unhappy as you believed the account to be closed.

You would like all charges returned, the default removed and the closure date of the satisfied account to be reflected correctly.

You could ask for something else financial for your time and stress if you feel so inclined.

TSB said I had to take it up with my partners Trust Deed! I think you are right that they just do not know what they are talking about. I have printed out a load of information about the effect of trust deed on partners credit - which clearly states it doesn't!! Yes I understand if we had a joint loan then they could chase me for the money but it was a current account with nothing in it that they have now put into an OD. Gr I am so angry about this but glad that you have confirmed what I thought. Thank you.

hi caz184,

It sounds like you have probably spoken with a call centre agent or someone within the bank who really doesn't know much about this sort of thing.

You may need to correspond in writing with them to have it resolved. Some good advice from Bert Rudge regarding this.

Let us know how you get on with it.
