Hi I am in the process of having my trust deed set up. Today i reveive a txt from my mum saying her lawyer is asking questions about me as im showing on a search that he has done on her house as they have sold it. Would this affect their new mortgage as i was told from an advisor it wouldnt. A bit worried why he would be asking

Do you have the same name as your mum? He will be searching the Register of Insolvencies and the Register of Inhibitions to make sure your mum has clear title to the house before she can sell it. Is your name on the title deeds?

These entries are held against you personally, not the house so it shouldn't affect your mums sale of the house if the house isn't in your name at all.

Hi Chellec.

I agree with mapleleaf.

My gut instinct is that the solicitor is just double checking that the actual seller isn't currently insolvent.
