Hi there, I am looking for some advice please. Myself and my husband were discharged from our protected trust deed in July 2016. We are in the process of remortgaging with a new lender and looking to borrow equity from our home. Everything was fine and we received our offer from the bank. They had one last thing to check which was confirmation from the trust deed company that they no longer had an interest in our property which they advised that they no longer did have. Unfortunately my bank have now declined my remortgage as the trust deed company have not formally discharged us?? I really don't understand this as both myself and my husband received discharge letters which we provided to our bank. The trust deed company say that it doesn't appear to have been done and now my trustee has left the company. I am going back and forward to the company and they've sent a letter to the bank stating they have no interest in my property but the bank won't accept this. Could someone please advise me what I should do next? Thank you.

Hi Jojo78.

This must be incredibly frustrating for you.

Could you take a look for your entry on the Register of Insolvencies please? There's a link to this and information about searching it at:

https://www.trust-deed.co.uk/searching-the-register-of-insolvencies.html

Are your details still listed on the register?

Is there a date next to "Debtor Discharge Date"?

Is there a date next to "Trustee Discharge Date"?

I'm wondering if the trustee has neglected to process their own discharge. If that's the case, I think there is probably a misunderstanding on the part of your bank about what this means.
