Hi folks. Just to give you the latest on where I am today and looking for advice as well please. My ptd runs out on Dec '11. I talked to the trustee almost six weeks ago and said to him a friend was willing to loan me 9000 pounds. When we first signed it was agreed we were to pay 15000. I advised him that was the most I could raise and would have to start paying my friend back immediately, therefore that was it basically. About three weeks we were told by his assistant he hadn't been in contact because he was waiting on creditor approval and would contact us. Today when we 'phoned to pay she said we should email her again, she would pass it on to him and see if he gets back to us again! Having looked at previous posts on here- basically he didn't ask us for any details ie current value, outstanding mortgage balance etc, to put a case forward, as in 9000 would be a fair amount considering current houses values, etc. All he said was there was some room for leeway. Sorry for being so long-winded but could you please tell me how long on average it takes for creditors' approval and why he didn't ask me to put a case forward as it seems to be common advice you guys give out?
When I said we 'phoned today to pay, I meant our monthly contribution.
Hi Ted34.
It's a little difficult to know exactly where your Trustee is up to in connection to your offer, some of the response you have had appears a bit vague but I might be missing something.
Maybe you could put your offer in writing, addressed to the Trustee personally, and include some justification as to why you think that it's fair and in the best interests of your creditors.
Thanks for the reply Amy. I have now emailed Wylie and Bisset. In my email I stated the current value of our home-this was based on the information provided to (and then from) zoopla. I also stated the value range as well. With that, put it would cost between 3 to ยฃ5000 to sell our home (I think Mark said this figure in a previous thread). Finally provided our outstanding mortgage balance and projected balance come December. Based in those figures, the bottom line figure was ยฃ7868. So my offer of ยฃ9000, I hope has shown to be "fair and in the best interests of your (our) creditors". I also stated that I would have to start paying my friend back almost straight away, so I couldn't pay him and keep paying into the ptd (as I know from here can happen), so I/we have only two options; either this offer is accepted or we sell the house and start afresh in the new year. Obviously I hope they accept the offer.
Hi Ted34.
Wyllie and Bisset certainly aren't a trust deed company that receives bad write-ups here in this forum so I'd be hopeful that you'll receive some firm feedback soon.
Please let us know how everything goes.
Thanks Amy. Hopefully I'll hear back by this time next week. I'll let you know when I do.
Thanks again.
I think I am going to be the first to lodge a bad write-up about Whylie and Bisset. It was the 29th March I put the offer to them, by telephone. Then, through advice from Amy (TDA, I then made the offer formal, through email and with researched figures on the 28th April. On the 13th May, I sent another email stating how unhappy we were with the time it was taken and not even receiving an acknowledgement of our offer, nothing. Last week I got a call from them saying they would do (and then 1 day later done) a drive by valuation. I was told I would hear back early this week, again nothing. In my "unhappy" letter, I asked for updates, preferably weekly, as I explained the urgency of our case. Basically if the offer is unsuccessful, then my wife and I would have to put ourselves on the council housing list as private let is too expensive. The longer this goes on the more likely we will get a house in an "undesirable" area. This was all explained to them. It is a constant worry and it's getting us down, big time. If we are to move away, we want the transition to be as smooth as possible for our children and not a big fall. This "limbo" state is the worst and it certainly seems Wylie and Bisset couldn't care less.
Hello Ted34.
I can appreciate that you're very concerned to keep things moving forwards at the moment.
We understand that there are a couple of members of the team at your trust deed company that take an active interest in reading this forum regularly. They'd be concerned to read about your frustration and, assuming they were able to recognise your identity from the content of your post, I'm sure would want to ensure you get some feedback soon.
It's good to hear that a valuation has taken place, the ball is obviously rolling.
The ball is rolling Amy, but it seems to be at a snail's pace. It's taking longer than to set up the ptd in the first place! Two months and counting.I can appreciate we aren't the only client they have, but this is our world. After stating our position; and for them to say they would 'phone us early this week, and haven't done so is unacceptable. After today, it looks like it will be Tuesday now before we hear anything. I got an apology for the time it has taken last week, but to then go back on his word and not 'phone me when he said he would makes the apology lip service. I don't like slagging off anyone, but it really is beyond a joke.
My final update on here has a happy ending. Had a meeting today with the "decision makers" in Wylie and Bisset. What a difference dealing with the top guys! Had been previously panicking over the uncertainty of it all. After a 15 min meeting..panic over. Our offer has been accepted, so the new year for us will be a totally fresh start STILL IN OUR HOME. (What a weight off!)To anyone looking for a company to deal with their (pending)trust deed, you'll not go far wrong with Wylie and Bisset. An ESSENTIAL piece of advice though...I can appreciate the chain of command within a company, etc, but when dealing with Wylie and Bisset INSIST either DONALD McKINNON or CHRIS WARDLE (or maybe even both)be in the room. First class! I would also like to thank (Oscars mode!) on here, Amy (TDA), Kevin and Mark for their advice with this and my previous post. Looking back, - sorry for not acknowledging your reply to me Mark, (head was somewhere else!)Rectifying that now. The job you guys do on here is fantastic. Never say never and all that, but I don't envisage needing your advice again. I'll be saying NO to credit cards, etc! Thanks again.
Well done......
