my trust deed

hi i have been paying a trust deed for 1yr now and just had a letter to review it it says you must tell them if you work overtime which i did not reslise thought you only had to tell them if you came into money eg.won the lottery what will happen as i havent told them also will they take all my overtime money eveytime i work it can they collect back more than you were due your debts in the first place.

It's normal for overtime to be taken into consideration and you really should have been told this at the start.

If you're earning overtime it's likely that some or all of it might have to be paid over to help repay your debts. Many companies will agree a split of overtime so that you can keep some and some goes to your creditors. We advise people to agree this (where possible) before a trust deed is signed. Once it is signed you're really in the hands of your trustee as to how much they'll require.

It doesn't happen often, but it is possible that people repay more than the amount they originally owed when they started a protected trust deed. Where affordable people may have to pay the fees/costs of the trustee, and some interest on the debts, on top of the original debt total.

This typically happens when someone comes into a lump sum, though it could happen if somebody had a significant increase in their income or reduction in their costs I suppose.

what will happen as i havent disclosed my overtime for the past year it is in the small print which i obviously didnt read and should have and overrtime has been regularly since the beginning and quite substantal

You'll need to talk this through with your trust deed firm bernie58.

They have a little discretion about how to deal with such a scenario.

If the amount they suggest is due is substantial it might have to be that the trust deed is extended to allow for this money to be recovered. That's just speculation however, the only important answer is the one that your trustee gives to you.

the company i am with is kmpg and after reading about them on here i am scared to send my wage slips my trust deed is already over 5yrs can they take you to court for not telling them

That seems extremely unlikely bernie58 as it's hard to see how your creditors could benefit from that.

hi regarding my query about overtime i sent my payslips and bank statements at the end of october with my annual review but still heard nothing how long should i wait for them to contact me as they must have seen the overtime payments by now so any ideas why they have not contacted me

Not really I'm afraid bernie58.

Maybe there is no issue, or maybe they have a backlog in processing at the moment.

I can only really advise that you follow-up with them to try to get some answers.
