There should be no impact on credit reports because nobody would go into a trust deed again for this reason. It's just a trustee being reappointed.

We can't speak for employers and their employment policies, but it's hard to see why anything would change for an employee when they weren't in a trust deed before trustee reappointment and the trustee reappointment doesn't put them back in a trust deed.

We also can't speak for banks, but it's hard to see why they'd close the account of someone who isn't in a trust deed and (after trustee reappointment) still isn't in a trust deed. I don't know how they could justify closing an account or why they'd want to.

Wildchild,

Interest on the money held in insolvency practitioner client accounts (if there is any) is held for the benefit of creditors.

Does anyone know when the Mond Case is likely to be resolved? on the Supreme Court Website it says the hearing finish date is July 3rd but there isn't any information about when a decision is being made. Any idea how long this might take?

Probably October. Supreme court adjourns for 2 months at end of July. Its unlikely to give a decision before then.

If the court decide in Monds favour, will all companies not have to reopen trust deeds?
I would have thought they are under a legal obligation to collect as much money as they can to reduce the amount owed.
I don’t see how one company can say they are not reopening trust deeds and another company is.

Hi sophie,

This would probably depend upon the advice that their regulatory professional bodies issue to them.

We're talking about professional obligations rather than legal obligations here I think.

My 2p worth.....(probably way off the mark, but nothing new there!!)

If Mond wins, and its a big if -

Trust Deed companies are businesses...
I can't see them going to the time and expense of reopening 20 years worth of trust deeds on the off chance there is some PPI to claim, unless they are certain of a return.

For PPI already paid out, I don't know how they can reclaim it if its already been spent!
If its not been spent, I don't know if there is any way to prove this, as you are not likely share your bank statements with an ex-trustee unless legally obliged to do so.

I can't see many firms gambling on reopening trust deeds unless they physically have the cheque in their hands!

If this happens (which it may well not) I think you're right amorphous.

A focus on dealing with PPI (of significant value to creditors) that the trustee happens to become aware of (rather than any kind of general fishing trip) seems likely.
