Yes TDA, Davison council did say that Bos could have set off against the debt, but I think he was meaning when the original claim was getting paid out that would have been before the Jan 2017 Donnelly vs.RBS which she won on appeal on the grounds that the final distribution was in effect a composition. so there was in the eyes of the law no debt to "set off" the compensation against. It strange that RBS never tried to appeal that, they cant use this Mond case as its on a different point. Davison bank BoS sent the cheque to the trustee. and he would I assume cash it and put the money into a holding account of some kind. Even Mr Monds council do say the money is tucked away in a bank account at about 15 minutes in the video.
And again at 1 hr 17 mins he said Mr Mond told the bank to send him the money and it's now sitting in a dedicated bank account.
I do hope Davison wins. It would help to things to Bed once and for all.
I'm also sure there is no further rights of appeal in the UK.

Thanks I thought same my former trustee from over 10 years ago go is holding on to my ppi monies. Said how long decision is depends if it’s appealed ?
Theres nowhere else Mond can go legally after this, should he lose.

I,m same boat wildchild ppi was paid to trustee who did say a few times to me they did where not interested in ppi claims money was paid to them they say u need to tell us cheque no ? claims company have sent me invoice or for nearly 2k which I cannot pay trustee wont pay it either they just seem to be hanging on to it not happy as it doesn't look if paying anything in me trust deed which I finished 2014 so it seems a varying view all round
Part that annoys me is so many ex debtors receiving ppi as former trustees not interested. Yet some are

If mond wins what. A carry on as everyone will need to be treated same and people that’s been given ppi monies as former trustee showed no interest. Where will at leave them
I have just been told I will be getting a cheque for £2000 PPI which was on an old trustdeed. Will this money be mine to keep or should I keep hold of it until I find out how the mond case goes in case I get chased for it?

Nobody can give you a definitive answer to this I'm afraid.
We don't know what the verdict will be and we don't know if/how other trustees (and their professional bodies) will react if Mond wins.
