Looking for some advice. I was discharged from my trust deed in June 2014, Susan Clay, trustee, from Phillip Gill showing as discharged on ROI in July 2014. Check Noddle on regular basis, slowly default cases being updated correctly, including 2 for Max Recovery (previous debts from First Direct/HSBC) which were included in trust deed and are showing zero balance and partially satisfied on credit file.

Today received statements for both from MR which states "required to send statements....until such point that there are no sums payable blah blah blah ". Statements show a balance as at 29/11/2014, and shows couple payments, obviously dividend payments. ALso states any queries I should refer to my current trustee Creditfix.

Should I be concerned? 1. Credit file is updated correctly, so why get statements that suggest otherwise and 2. Why is it saying my trustee is Creditfix, as my case was all closed with Phillip Gill before they transferred some of their clients over.

Advice gratefully appreciated.

Thought I'd also add, my credit file was updated back in July with zero balances and partially satisfied by Max Recovery, which makes the statements even more strange.

Also, really don't understand why Creditfix is mentioned, surely they wouldn't even have any of my info as my trust deed was all done and dusted back in July.

Hello lizs.

If your trustee at Philip Gill discharged herself (as well as you)I see no reason for Max Recovery to mention the name of any other firm.

I think you just need to ensure that Max Recovery are aware that no sums were due to them by you from the date of your discharge and that their statements provided to you should reflect this.

Hi TDA.

This was why I was slightly concerned. ROI clearly shows trustee discharge of Susan Clay back in July, so have no idea how Max Recovery would have Creditfix listed as my trustee as I technically don't have a trustee any longer. Hence shouldn't be getting statement with any balance in first place, especially when my credit file confirms balance now zero.
Will write to them over the weekend explain my discharge back in June etc and requesting that I get no further statements showing any balances. Im also going to query why Creditfix mentioned at all as I have had no association with them.

Thanks again.

Hi lizs.

It is a bit odd. I wonder if they're just updating their records of cases that they're assuming might have been transferred recently?

Surely its a bit risky for them to make such assumptions, but understand where you are coming from. Its just not adding up right. My case was closed 6 months ago, so I shouldn't even be getting anything from them at all.

Do you happen to know, or anyone for that matter, of a landline number to call for Max Recovery CCA Enquiries, number listed is an 0845, and wont phone that from my mobile lol.
