Hi al. Tidying up my credit file post PTD completion (Nove 11), and one of the accounts is being diffilcult with me - it is showing that I have a zero balance but this year I have 12 missed payments?? I contacted Experian and this is the response that was given to them

*CL Finance Ltd (Account started on 06/07/04)
CL Finance Ltd confirm the details we hold are accurate and ask that we keep the
information on our database.

They have informed us that the status '6' on the credit file relates to 6 months
or more contractual arrears.

They agreed to accept reduced monthly payments due to financial difficulties
however this reflects on the credit file.

After 6 months they could have entered a default but they felt this would put
you in a worse position therefore they left such.

This will remain on the credit file for a period of 6 months from the final
payment
.

Is there anything else I can do as I believe that this is keeping my credit score down considering that this was part of the PTD, and that everything in relation to this is now closed

Hi Duncra.

I'll start with our standard warning which applies to all credit reference agency questions... it's a little out of our main area of knowledge. However, we've had a few conversations with the Information Commissioners Office over the years to clarify some questions that we've had (often prompted by questions on the forum).

The basic principle behind the ICO expectation (remember the ICO is responsible for matters connected to the Data Protection Act) seems to be that the content of a credit file reflects the reality of the situation. There is more about that at:

So... I would speculate:

1 - The fact that the balance has been reduced to zero seems to be in accordance with that principle.

2 - The fact that missed payments are being recorded after you have been discharged does not seem to be in accordance with that principle (because you cannot miss a payment that you do not owe?).

You may therefore wish to address the second point with CL Finance directly. If they don't respond as you hope you may then want to raise the matter with the Information Commissioners Office to see what they have to say.

Thanks TDA. I have just sent them an email re this. I have also noticed that they have an arrangement start date of 1st July 2006 - with this being the case should this not have dropped off of my file now as well?

I don't really know I'm afraid Duncra.

Perhaps that date remains there in connection to the new reporting that they have continued to add?
