1681.

You should contact your trustee and ask them to explain why they think they should keep this money.

The only reason the trustee would or could keep the money would be if it was due to the creditors under the terms of the trust deed.

It's quite possible that they've just been the recipient of this cheque, posted to them by the people handling the will, and that it will be resolved in due course.

I'm sure you will based upon what you've written here 1681.

They may require some confirmations from you and/or the person handling the will, but presumably this would just be a matter of formalities before everything gets worked out and resolved.

It's incredible that your trustee is asking you to define the law under which he has taken the money!

Advise him that the funds are acquirenda ie assets which are obtained after the date the trust deed was signed and advise that his entitlement to such funds are determined by Section 32(6) and that entitlement deals with assets acquired after the date of signing but BEFORE the date of discharge.
Hi Mark I have just been informed that yes I was discharged in 2001 but the TD is still active and ongoing.

Hi 1681.

My gut instinct remains that this isn't the problem that you fear.

Two questions that I'd suggest you ask your trustee directly:

1 - Are they actually holding the funds?

2 - What documentation do they need from you (or the people handling the will) that this inheritance became due to you after your discharge? That might include a copy of the death certificate for example.

It's worth checking with them about the funds 1681.

If they haven't got the cleared payment available to them they'll obviously not be in a position to pay it over to you yet.
