Hi All,

Just a quick question. I am nearly at the end of my trust deed and I was wondering if at the end of it could I be made to sell my property even though I am not the sole owner?

Hello jayfin01 and welcome to the trust deed forum.

The answer to this, as so often, is that it totally depends upon your circumstances and what has been agreed with your trustee.

Is there equity in your property?

Was there a discussion or agreement about how equity would be dealt with at the start of your trust deed?

Hi TDA,

We bought the house at the height of the property boom 7 years ago so I would be suprised if there was equity but I wont know until the property is valued.

I think what I need to do is look out all my paperwork from the TD as i'm assuming the answers will be there.

Hi jayfin01,

As TDA has said it depends on what the position was at the outset of your Trust Deed.

It might go in your favour that you purchased the property when the market was at its highest. You may find now that your property is in negative equity which would mean it could not be sold.

If you can confirm what the agreement was at the outset to deal with the equity we can advise you further.
