joint debts

My husband and i seperated about six months ago. he is in a trust deed and I am considering entering into one also.I am being chased by our estate agents for 3000 pounds and now the child tax credits for 1200. both these debts are joint, however because he is in a trust deed they cant chase him.Is he not still liable for these debts and can he not just get them added to his debtor list.He is now been in TD for about 3 months now

Hello linz,

The general rule with joint debts is that each of the parties has "joint and several liability" for the debt.

This means that each party is fully responsible for the full amount of the debt.

Any payment from the Trust Deed towards those joint responsibilities will reduce the remainder of the balance for you. The rest I'm afraid will remain your responsibility.

If a Trust Deed were appropriate for you, and you decided to go ahead, you would be expected to pay only what you can afford towards the debts.
