It's finally over!!

Form 5's finally came through today from Creditfix as promised [:D]

Looks like Creditfix are fulfilling what they have said through TDA's previous post, hopefully this is the sign of things to come for others in a similar position to myself.

Thanks to everyone who posts on here for the advice they provide, while I may not have asked the questions I still read and took on board the replies.

I'll still post to update on clearing my credit rating journey as that will begin soon, in the meantime I might have a wee Beer tonight to celebrate now [8D]

That's good news RYB. We were discharged on the 2nd March (having received form 5, then form 6 being issued and 14 days after assume form 7 was submitted. We're still waiting for the discharge to appear on the AiB site. Am I reading this right that the trustee has another 28 days to register the discharge with the AiB?

According to the website ( http://www.legislation.gov.uk/sdsi/2013/9780111021361)it can take up to 28 days. Am I reading this right?

Discharge of trustee

25.ÔÇö(1) This regulation applies where a trustee under a protected trust deed has made the final distribution of the trust estate among the creditors.
(2) Not more than 28 days after the date of final distribution, the trustee must apply in Form 6 for discharge to such of those creditors as have acceded (or are deemed to have acceded) to the trust deed.
(3) The trustee must send to the Accountant by the date of applicationÔÇö

(a)a copy of the Form 6; and
(b)the accounts of the trustee's intromissions for the last period for which accounts must be sent under regulation 21(1).
(4) For the purposes of paragraph (2), the ÔÇ£date of final distributionÔÇØ is the date on which all of the estate distributed has been placed beyond the control of the trustee.
(5) A creditor who does not respond to the trustee's application within 14 days after the trustee makes it is deemed to have agreed to the trustee's discharge.
(6) If a majority of the creditors in value consent to the application, the trustee is discharged.
(7) On being discharged, the trustee must within 28 days of the date of dischargeÔÇö
(a)inform the Accountant of the discharge;
(b)send the Accountant, for registration in the register of insolvencies, a statement of realisation and distribution of estate under the protected trust deed; and
(c)send the Accountant, where accounts submitted under paragraph (3)(b) require to be revised, the revised accounts.
(8) A statement under paragraph (7)(b) is to be in Form 7.
(9) Where the trustee's discharge is granted under this regulation, the discharge also applies as regards any previous trustee under the trust deed unless, under regulation 28, a person with an interest obtains an order to the contrary from the sheriff.

So at this stage your own discharge (Form 5) hasn't been updated on the Register of Insolvencies?

Hi TDA. Form 5 and Form 6 show up on the website for my husband - I cant access mine as only he was sent a letter with login details. Meanwhile the 14 days were up on 2nd March and nothing has shown up yet on the aib.gov.uk website which I check regularly. Does that clarify? I spoke to our trustee about the letter with login details and he said mine must have been lost in the post - he tried but doesn't know how to get another letter issued so I just have to rely on the info showing up in the AiB website.

It's not official until it's on the Register of Insolvencies RoseG.

I'd just watch for progress on that. They seem to be pretty quick once the trustee gets the form to them.

Still waiting and checking. TDA I contacted our trustee - he emailed back to say he'd sent off the form 7 and that he thought AiB are working through a backlog. It helps to know why but oh dear - am chomping at the bit! I wonder if others are in the same situation. RYB - its great yours is through.
