Is there such a thing as a joint TD

I signed into a TD in 2008. My debts totalled 7k, My wife had debts totalling around 5k. I signed the trust a few months before my wife and am sure that some of my wifes debts are on my TD to make it up to 10k, the same happened on hers. Is there a way to check the details of my trust deed and what debts on them.

Hello Stevie and welcome to the forum.

Did you have any joint debts?

I'd suggest that you contact your Trustee. It should be very easy for them to access and pass on this information to you.

Sorry... meant to add as well that a Scottish Trust Deed is for an individual. Where a couple both enter Trust Deeds they will each have their own but of course the financial information will be co-ordinated to ensure fairness and affordability.

Thanks,

My wife recently informed me that she has not been paying her TD (4 months since she last paid it). Will this affect my TD, The TD company is now issuing a Sequestration on my wifes account and wages. This is really worrying me, I have contacted the TD and they were not very helpfull ("ask Mrs Baxter to give us call") i have found several letters sent to my wife she has ignored. Whats my best option as i feel the TD company will speak to me on this matter and my wife will not call them.

No we rent a property, I pay for all in the home (rent, gas, elect, Food and clothing of my salery). Most months are really tuff and am finding it difficult to cope with day to day finance. We have no assests and to my knowledge i have have no joint debts with my wife. There was a question a couple of years ago when my wife failed to pay her council Tax at the home she lived with out myself. This debt was billed to myself and my wife shortly after we were married, I conatct The council and had them re invoice to my wife as i did not live with her during the period they billed us.

I think the company involved will be happy to tell you which creditors are included in your Trust Deed.

If your wife writes to them authorising them to discuss her affairs with you they should then do so.

It doesn't sound as though your wife's potential sequestration will affect you. However it must be remembered that if it is calculated that your wife can afford to make a contribution towards her debts she will still have to do so in sequestration (three years... starting again). This may have an impact on family finances?

If you're both struggling to make the payments perhaps you should discuss the overall payment amounts with your Trust Deed company. You might be able to pay a little less for a little longer so that it is easier to manage.
