Thanks in advance for any help today. Having recently been told of an inheritance this will enable me to make early full repayment of my PTD, I have let the company/trustee know of my intentions but am worried that a family member who is executor will be made aware of my financial situation and of the PTD. Is the executor likely to be made aware? This will cause issues in the relationship. What are the options, if any? thanks in advance.ย

Hi CelestialR - welcome to the forum.ย  I am sorry to hear about your bereavement.

I can understand your concerns, but I'm not sure I can give you a definitive answer I'm afraid.ย  It is possible that the executor will find out about your Trust Deed, though it is not certain that they would.

The executor may themselves check for your name on the Register of Insolvencies before paying out any inheritance, so would see you on there.ย  This is more likely if it there is a solicitor involved with the executry of the estate, less so if it is just your family member dealing with it all I guess.

The other way they could find out is if your Trustee insists that the funds are paid directly to them and therefore seeks to contact the executor to arrange this.ย  They may do this in order just to be sure that you don't try to avoid paying the money across to them.ย  Hopefully the fact that you have been up front with them about this will mean they don't feel the need to do so.

Fingers crossed that neither of these things happen.ย ย
