In debt again....

Hi,

My trust deed is due to end in September. From the first day of signing my trust deed, I have never heard a peep from my insolvency practioner...should I be concerned?

My biggest problem is that my wages have been arrested for a debt of £3000 due to a housing benefit reconsideration and court costs that were accumulated when I was evicted from my house as my landlord wanted the property back for her daughter and the Council wouldn't help until I was removed by Sheriff Officers.

They are taking £330 from my wages each month. I also have another debt coming of £5000 from HMRC for overpayment of child tax credits due to an unexpected annual bonus which meant I wasn't entitled any longer for that year.

Not really too sure where to go from here....bankruptcy? How will this effect me as I work full time.

Hello MissK1988.

It does seem a little odd that you haven't heard from your trustee, for reviews for example. You may wish to check that they hold your correct contact details.

Can you still afford your bills and trust deed payment with that wage arrestment in place?

Sorry to hear that you have found yourself back in the position of having debts. It's actually a lot more common than you would think.

It's a little unusual for you not to have heard from your Trustee since the start of your Trust Deed. If you have changed address for example and not updated them and changed mobile number than this could be why.

I would give your Trustee a call and ask them for an update on your case. That way when you come to be discharged you receive the paperwork and Form 5 discharge certificate. When you say due to end in September, do you mean in 2016? As TDA has asked, with the wage arrestment are you in a position to maintain your payments to your Trust Deed until you complete it? If not, you may want to speak with your Trustee to see about a reduced payment as the last thing you want to do is struggle to pay your current rent, council tax etc.

In terms of the additional debts, were you evicted from the property after you entered into the Trust Deed? Also, did the benefit overpayment happen after you entered into the Trust Deed?

You could consider Sequestration to clear the debts or you could consider a second Trust Deed for the debts but this would need to be looked at a little further with an advisor. The issue could be completing the first Trust Deed first.
