I apologise in advance, this might be quite long.
I completed my TD payments in March and paid my property abandonment fee in May this year and was advised it would take 6 months to receive my Form 5 (it's Knightsbridge!!!!)
I phoned up 3 months ago and asked to be discharged as there was no reason to with hold my discharge until they heard back from my creditors, I was told that the final letters would be sent out within 2 weeks and if they hadn't heard back within another 2 weeks they would close it down. Today I phoned for an update and was told they haven't heard back from my creditors and the final letters would be going out within the next 2 weeks. Cue lots of shouting and complaining from me!
Three months ago I was told that the supervisory team were going to ask the trustee to discharge me early based on exceptional circumstances and someone would be in touch. That never happened.
After 30 minutes of me complaining they have said they will process my Form 5 by the end of this month. I've advised them that if I don't have it by next Friday I'll be putting in a complaint to the trustee, the ombudsman and the IFA. Am I within my rights to do that?
On a separate note, I'm looking to rent out my property and was wondering if my mortgage lender is likely to agree to change to a buy-to-let mortgage? My husband still has 5 months to go on his TD - would that have an impact?
Well don't if you got to the end, and thanks in advance for any advice!
Hello FinishedMarch15.
It must be very frustrating having to wait such a long time for your discharge.
You certainly have the right to make a complaint if you deem that to be appropriate. Initially that would normally be to your trustee, then to his/her professional body if you're unhappy with the response.
The Financial Ombudsman may not be able to help - insolvency appointment conduct usually falls outside of their scope.
Regarding your mortgage, I can only really advise you to pick up the phone to the lender. Some might see additional risk, others might not perceive any cause for concern from such a switch.
