Hiya,
I entered a TD in 2010 and have 12 months left. My mum has said that she could help pay it off and I owe her the money instead to help get me back on my feet.
Is this something I can do and if so, does it help me move on with creditors?
Any help and advice very much appreciated?
Thanks

Welcome to the forum willowgirl.

Well done on reaching the latter stages of your trust deed.

This is a question you'll need to ask your trustee. We've learned here over the years that they see this in different ways.

Some may agree to accept a sum equivalent to the remaining payments and discharge you early.

Some may agree to accept a sum equivalent to the remaining payments, you'd make no further payments from normal income, but your discharge would be held up until the expected end date. This would be to ensure that your creditors benefit from any windfall that might come your way during that time.

Some may refuse to discharge you early unless the sum paid is enough to fully repay your debts, the trust deed fees and possibly interest on the debts.

Best to contact your trustee to see where they stand on this issue.

Good News!
Question asked, can my mum help and pay off the remaining year? Yes, is the answer. The remaining lump sum to be put into existing account. They will then discharge after receiving - I will receive Form5.

I was told when I enquired that I owed much more - (nearly fell off chair) and they had not received a payment from July last year. This not being true as payment left bank each month - I am taking bank statements up to them so they can pass to their accounts office.

The lady - very nice and helpful did say since the change in company, they have had a few problems so I would urge anyone who was with RSM tenon to contact the new company for a balance and if necessary pass proof of payment so your account is up to date.

Hope this helps?
Thanks

Hi willowgirl,

That was quickly resolved and I'm pleased to hear that your Trustee has agreed to close your Trust Deed early and give you your discharge.

The issue over payment should be easily resolved be providing your bank statements.

Once your mum makes the payment make sure you chase up your Form 5 discharge.

That's great willowgirl.

Good to hear that your trustee has given you an answer so quickly and shown this flexibility to you.
