Hi there.

My Trust Deed became protected on 25th May and since that date I have had several warning letters from one of my creditors threatening court action. I emailed them and explained that they are included in my TD and should be contacting my trustee and not me. They say they have not received any intimation from my trustee in regards to a TD but trustee says otherwise.

Am I right in saying that while the creditors is included it would take some time for the trustee to get round to corresponding with them? And if the "advertisement" ended on 25th May that they shouldn't be contacting me after that date and that I am now no longer able to undergo legal proceedings?

Your creditors will have received both the initial proposal and confirmation of protection by this stage.

It is not unusual however for that information to take some time to filter through to the relevant departments. Particularly if that creditor utilises a third party for the assessment of any Trust Deed proposals.

The trustee will not know which creditors continue to chase you unless you advise him or her accordingly so I would recommend simply forwarding any creditor letters to your trustee.

Whilst it is clearly within your rights for you to call your creditors the Trust Deed is there to take some of that pressure off you and, as you have already noted, calling them is perhaps not the most valuable way to spend your time, especially as legally there is no action they can take after protection has been achieved.

Hi Terrestrial1,

Like VOR has advised paperwork will have been sent to the creditors already on at least two occasions. It’s common for creditors to not update their system’s at the start and for letters to still come out in the post.

This isn’t anything you need to worry about as your Trust Deed is protected. Best advice is contact your Trustee and forward them a copy of the letter and leave it to them to deal with.

You will still occasionally get letters like this throughout the full Trust Deed period but like I’ve said it’s nothing you need to worry about.

Hi guys.

Thanks for the information, it's been really helpful. Today I received a letter from PRA group telling me they have bought my debt from a creditor, that it isn't a demand for payment and that they will correspond with my nominated representative. I assume the creditor has just sold this on to negate loss and that they will have told my trustee?

Yes, it’s common practise for the original creditor to sell your debt on to another creditor. They will have informed your Trustee about this.

This might happen with some of your other debts throughout your Trust Deed but it’s nothing that you need to worry about.
