Hi there!

I’m half way through my Trust Deed, due to finish in 2020. However, my circumstances have changed. My husband originally talked me into doing the TD in the first place but then he left me last July. He still pays his and I pay mine but I’m currently stuck in our house because of it which he is now refusing to pay half the mortgage on. I’m trying to find a way to get out of thr Trust Deed faster. Is there any way to do this?

Hi Aitken

If the trust deed was signed after 28 November 2013, the only way it can be closed early and for you to be granted a discharge is if you are able to pay all debt included in the deed, statutory interest and trustee fees.

There are other ways a trust deed can be closed off such as the trustee resigning from office or petitioning for sequestration.

If your circumstances have changed, I would recommend speaking with your trustee. They will be able to provide guidance and support and outline the various options available to you.
