fleeing abroad!

I still get the mail that comes to my old address and have started getting demands from collection companies addressed to my ex. We both entered TD's after we split up but she has fled abroad and stopped paying into her TD. I take it this probably means she has been discharged and she is now accountable for the debts again.

We still speak as we have kids together and she is certain that she is never coming back to the UK to live (she's Irish by birth and only came to live here after we met). What measures can be taken against her now if she has disappeared to the Middle East? Is she likely to face any consequences if she comes back with my kids for a visit? Obviously I don't want her to have any reason not to bring my kids over to visit me and the family.

Hi upstream.

If the trust deed has failed her creditors are free to start collections activity again. Will they trace her overseas? It's not impossible but it would be an expensive task. The creditor would then have to use the recovery laws in the country in which she resides if they wanted to enforce the debt (and I'm not sure that is possible in every country anyway).

I cannot see that there would be any consequences should she visit the UK. Unless there has been some criminal activity (which I'm sure there hasn't) I cannot think of any potential problems.

Thanks TDA. She's pretty law-abiding - just a nightmare with money. Not that I was all that great with it myself hence the TD!
