Hello, just looking for a little advice I have been in a protected trust deed
For a little over 2 years.

My hours were recently reduced due to COVID 19 which has resulted in a loss on wages and not being able to afford payments. My hours are back to normal now so will be back on track with payments next month.

I had sent and email to my trustee explaining the situation and sent over my payslip for proof of income and had an automated response saying the turnaround time was 2 weeks so I phoned to let them know. When I called my trustee last month to explain my situation to see if it was possible for a payment break for 2-3 month just until my wages went back up and that I understood that my trust deed would have to be extended, I was told that payment breaks were not allowed (although I have seen otherwise they are if it is out of my control which it is) anyway, they said they would authorise for that month and put a note on my account and told me to ignore any emails or texts as they were just automatic and to call back next month if In the same position. So I called back a couple of days ago and explained the situation, I was told there was no note on my account and that missing the last payment was not authorise and could also not authorise this month. He asked what my wage was and when I told him he said that that was more than what my income as on my record. This is when I discovered that they have never updated my record after sending in the annual review (my payments remained the same so this is why I didn’t know) I had also moved in with my partner which they were notified of and had sent the tenancy agreement like they ask for proof and was asked if I had permission for this which I had. I told him this was all sent in by email and I still have every email I have sent which I am glad I do now as I would have no other way to prove that this was not my fault. In the end up when I said this they asked if I could re send the emails so someone could check over them. I also said my payments will be back to normal next month as my hours are back up to normal now but overtime is a month behind so will be on the next payslip.

I just don’t think my trustee is being very fair as I was always told that a trust deed was based upon affordability and to be honest I am worried sick, I have been very anxious about this all weekend because I can’t afford to pay this month and I am unsure what will happen with this as I have still had no reply from them. Any help would be grateful to settle my nerves. Thanks

Welcome to the forum Needinfo27.

A trust deed payment is based upon an affordability calculation. If no payment is affordable (and the trustee is aware why) then they really shouldn't expect anyone to make a payment.

I've read about specific guidance given to trustees about showing flexibility to those whose ability to pay into their trust deed has been affected by Covid-19 financial problems.

It doesn't sound right that you have supplied updated financial information which has been ignored by your trustee. You have every right to be frustrated and annoyed by that.

You do have the option to complain to your trustee (and then to complain to their regulator if you're unhappy with your trustee's complaint response).

Perhaps at this stage though you might want to see what they'll come back with after they have processed the information that you have previously provided?

Thanks for getting back to me. Yes my thoughts were to put in a complaint as I do think it’s not okay that they haven’t replied to any of my emails and the information I have provided has been ignored. Yes I am going to see what they say, it will be a week tomorrow when I re sent all the information and I have still not received a reply. Is there usually a tome frame for them to process this information?

There isn't a set timeline Needinfo27, though given the circumstances I think it would be reasonable to expect them to treat this as a priority.

It might be worth chasing them for an update.
