Ex & Mortgage

Hi

I split from my ex 2 years ago and not paid into mortgage for 12 months. We had a previous house that she was soley on mortgage as i was black listed but paid every month to her account to cover bills/mortgage etc etc.

We made 70k profit but when we moved i feel she pulled the wool over my eyes as i wasn't clued up and she was in the property game, she made me sign a trust deed saying any deposit she paid would just be hers from last house and i was not entitled to it. I have since found out if i was paying towards mortgage but not on it i am still entitled to split on equity on last house?

I am on this mortgage and and know i can get back what i paid in and any equity, i have 3 kids with her and i have been paying her £1000 a month for last 7 years plus paying the mortgage on a joint account with HSBC. Do i need to remove myself from it or what do i do and can i argue that i was deceived about equity from last house because i paid towards bills/mortgage and can prove with bank statements?

Hello patterg and welcome.

I think the type of "trust deed" that you're talking about is very different to the subject that we're covering on this website.

We're talking about a specific personal insolvency procedure that exists in Scottish law.

I think you're talking about a document that clarifies wishes and intentions when a home is bought jointly? If so I'm afraid we've no qualifications to help you.
