Hi all. I now need to do something formal as two more companies are starting to play silly-buggers. RBoS is now sorted. But HFC have started legal procedings I have spoken to their solicitors and they have agreed to Decree and payment by installments of £24.00. The other one is GE money they sold the debt to Link Financial who have started hounding me. I have explained to their solicitors I was paying GE Money £19.63 per month until they sold it to link and link started demanding £600 per month. I have said I will defend their court action as I had an agreement for £19.63 and could continue with that amount. they are seeking instructions from link. But this is starting to put a strain on us. As soon as I get one sorted another one starts playing up. Who will be next?.
Any advice would be great. I still really want to fully pay the debts, even if it takes a long time.
Hi Head-just-above-water
Unfortunatley debts being passed from debt collector to another debt collector is a common problem and they can be difficult to keep track of. The only way to ensure creditors cannot take further legal action is to have a legally binding agreement such as DAS or a trust deed.
Have you sent an income and expenditure to link for them to consider?
Hi TDA, Yep sent that to link, don't care, came back with borrow the money to pay us before everyone else, then dropped their demands to the 600 per month. I have sent the i&e to their solicitors to see if they can make them see sense. I intend to attend court to put my case forward. HFC are going to accept(via their solicitors) the £24 per month but want their decree. I thing the DAS is the best way forward as they all will get there money.
That is correct, with DAS you pay back 100% of what you owe but the interest and charges are frozen and you have the legal protection.
I suggest that you act quickly as legal action in involved. DAS can suspend that type of action, where required, pending creditor review/approval.
