Does trustee have to wait 36 months to discharge?

If you have made 36 payments to your trust deed can the trustee start the discharge procceedure right away or do they have to wait the full 3 years from when you signed to start the discharge procceedure?

Hi littlemo, I think they can, but it has to be approved by the creditors. If it's too close to the end of the initial period tho, it might not be worth the hassle of writing to them, so it's probable that they will just let it run out. I was in a similar situation.

Ask the trustee concerned littlemo.

Some would probably be happy to get the ball rolling if the 36 payments had been completed.

Others might want the term to expire.

Hi littlemo,

With two payments remaining I can't see there being a problem with starting the closure process early if both payments are paid in one.

A Trustee is usually wary of closing a case too early in case the client receives an large windfall or inheritance and the creditors miss out on it.

Speak with the Trustee and let us know how you get on.
