Hi, everyone
I tend to be a bit of a lurker on the forum as most questions I have had were addressed by other subscribers.
I am pleased to say that I have been discharged frommy trust deed. I think that means that after 3 years of paying into it, its now finished. The company who administered it only kept in touch every 6 months when looking for info to carry out a review.
I've tried unsuccessfully to contact them and never get a call back or a respinse to my emails.
the last thing I have from them last week was a form 7 which showed my creditors etc. There was also guidance on how to update my credit report.
This made me assume I had successfully completed the trust deed. However, I received a letter from one of my creditors yesterday demandin payment of outstanding balance of ยฃ1700. I checked the form 7 and they are included in the trust deed but I don't really fully understand the form.
My questions are :-
1. Have I completed the trust deed.
2. Should there be a balance that I am still responsible for paying to creditors who were included in it.
3. Does my administrator still have an obligation to assist with queries I have.
Sorry for the short story but I'm back to worrying after 3+ years of being relatively stress free.
Any advice welcome. I haven't mentioned trust deed company name just in case we're not allowed to.
Thanks
Lynn
If you check the accountant in bankruptcy register online you can check to see if you and your trustee have been discharged. Once you get discharged you'll receive a Form 5 from your trustee. If your trustee hasn't been discharged then they can still deal with the creditors on your behalf (once the trustee has been discharged you'll get a Form 6).
If the creditor who has demanded payment was part of your trust deed then they aren't due anything more from you. In fact, all unsecured creditors you had before the TD are now due no more from you whether they are included in your list or not. That is why the TD was advertised in the Edinburgh Gazette when you started out. They can't do anything legally to pursue any debts as they no longer exist.
Try and get in touch with your trustee to confirm you are complete and discharged so that you can cancel your standing order to them. And congratulations on getting through it!
Glad that's over with....
Hi LynnMac2011.
You're discharged as far as I can see, congratulations.
Form 5 is your discharge. Form 6 is your trustee's discharge. Form 7 comes after that.
If you want to see it in black and white visit the AIB's Register of Insolvencies as upstream has already suggested.
The debts covered by your trust deed no longer exist no matter how much a creditor might act otherwise. You could ignore them, or give them your discharge details so they can update their files and leave you alone.
Your trustee no longer acts for you (or your creditors) but it doesn't seem unreasonable to ask them a question if you need to.
So... no reasons to worry and lots of reasons to feel happy!
