Hi, I was discharged back in February but still waiting for the trustee to get discharged on the AIB which they are still
Showing.
Over the past year the debt has been passed on to Link, Arrow and PRA group. I had just received statements last year with balance but that was it but now over the past month they are send letters out requiring payment. I thought they would know I was in a trust deed? I thought they would have had part of the money by now. I have emailed them but itโs not a quick fix especially at the moment. Plus defaults dates are all over the place with some putting there default dates back at 2018 when they took over the debt. Between those 3 companies they have took on 6 accounts.
Any advice?
Hi Jroger,
The only thing that really matters here is your discharge. There's no need for you to respond to the creditor letters because there's nothing that they can do.
You could supply them with a copy of your discharge if you want them to stop contacting you directly.
This article explains what you can do to get default notices backdated to the start of your trust deed:
Thanks TDA.
Just with the default dates don't match when I entered the TD. The TD will fall off my report Feb next year but these defaults will still be on.
Hi Jroger,
Sections 6 and 7 in https://www.trust-deed.co.uk/repair-your-credit-rating.html should answer your questions on this and point you towards the actions you can take to address and fix this.
Default notices issued after your trust deed began should be backdated to the point at which your trust deed began. This means those accounts will fall off your credit file at the same time as your trust deed.
We've heard from people who have made complaints about incorrectly dated default notices who have subsequently received some compensation as well as a correction on their credit report.
