Discharged 3 years and Trust Deed firm claming PPI

Hi all lurked for a few years a while ago but not been on the site for a while anyway yesterday I get a letter from Blackhorse Finance saying they are paying Campbell dallas money from aPPi claim they have made.Now the thing is the blackhorse loan was secured on my house and was not in the trust deed ! and I have been discharged for 3 years and so has my wife so how can they claim any PPI and can I challenge this thanks in advance [:(!]

Sorry just got the discharge letters out and it is actually 4 years ago we were discharged

Hi zander123.

It's not relevant whether or not this account was a part of your trust deed.

What happens next isn't something that's especially clear. Your ex trustee may be happy for the funds to come to you, or it might become more complex.

Best to contact your former trustee and ask them whether they're happy to see the funds released to you (or not).

Hi and thank you for your reply I am not on the AIB regester haven't been on it for years and have been discharged for 4 years so how long can these people chase any money the creditors have been payed out so is the money going to Campbell Dallas. they all ready got more money from this trust deed than anyone else

Hi

Has your trustee been discharged? You should be able to find that out, if they have then the funds should come to you.

Are you sure this isn't actually the firm paying out the PPI claim that have chosen to send the payment to your former trustee?

Or that your former trustee might very happily forward the payment to you if they determine they no longer have any interest in this matter?

Hi zander123,

Have you spoken to Campbell Dallas to see if they are intending to try and keep the money from Blackhorse? If your Trustee has been discharged itโ€™s hard to justify keeping the money.

If a Trust Deed has existed at any point then lenders as a matter of course generally always send the money to the Trustee even if they have no interest in it.

It could be the case that Blackhorse will send them the money and CD will return it and confirm that you should receive the money.

Once my firm as Trustee is discharged from a Trust Deed we have no further interest in PPI. If a company sends us the money we will either forward it back to the company or to the client.

Speak to CD about things and let us know how you get on. Iโ€™m sure a quick 5 minute will clarify things for you.

They may have kept their own insolvency records, or they might have found an entry on the Edinburgh Gazette website. Sadly the Gazette is permanent.

Hope you get a positive answer when you contact your former trustee.

I take it the whole ex-trustee looking to be re-appointed thing has dies a death then? At one point it looked as though that was the general direction of travel (until the CoS appeal was dismissed).

I think Cacmpbell Dallas will send the funds onto you Zander, or back to Blackhorse who will issue a cheque/bank transfer

I'd suggest "on hold" rather than "died a death" tinsoldier.

The thing is, the number of firms actually doing this was pretty limited anyway.

It seemed to be quite a few firms from what I recall at the time, and the consensus was that more would take this lead and the direction of travel would be seeking re-appointment as the norm.

If the Supreme Court appeal fails of course then we will know once and for all. Thankfully!

I think certainty would be appreciated by all.

The point made about more trustees potentially starting to do this (previously) is probably right. It would have become harder and harder for firms to not recover these funds for creditors if it was clear that other firms were doing so and the law was supporting their actions.

Remembering back, a long time ago, there was a fair bit of shock and dismay here when the first trust deed providers investigated PPI at all (for customers who were undischarged). It was new, few firms were doing it, but it very quickly became the norm.

Hi all just to let you all know the PPI is one my wife tried to claim a few years ago and got rejected at the time and she got a form a few months ago from Blackhorse to appeal and filled it in and forgot about it so not Campbell Dallas trying to claim PPI. The Letter from Blackhorse had a Reference number for Campbell Dallas on it, any way today I phoned Cacmpbell Dallas and after a five minute call was told that they have told Blackhorse they have no interest in the PPI and to expect a Cheque through the door and to enjoy it, Thank you all for the replys and support I will still lurk now and then on the site Merry Christmas to all

Oh and also Blackhorse knew about my Trust deed because they are part of the Bank of Scotland Group and we had a loan in the trust deed from them but not Blackhorse
