I am in great need of advice here please. I made my last payment to my TD 4 months ago now. I haven't had any form of discharge letter to say that is it over with. I have called twice in the last month and had verbal confirmation that it is finished and they have marked it for completion but I haven't had anything yet. Once I receive this letter of discharge, where do I stand legally in terms of my TD being able to claim future assets / money from me even after completion?
I am not coping well at all with this, it has been a stressful 3 years and I just want it to be over with but I feel I am not debt and worry free after 36 months like they continously advertise. Please help?
Hi The_End and welcome to the trust deed forum.
Once you have been formally notified of your discharge the rules of the trust deed no longer apply to you. Assets that come into your possession after this cannot be affected.
Four months seems like a long time if all of your obligations to the trust deed have been completed. I do hope that you're not asked to wait much longer.
Thank you for the quick reply. That's what I thought. When speaking to them not long ago they were quite surprised that the completion letter hadn't been sent. I get the impression that someone has messed up somewhere. On top of this, they are now trying to pursue ppi...can they do this after discharge? I just want to move on and not harass my creditors anymore, especially when i know that the majority of the money goes straight back to the TD company anyway and not my creditors.
Help much appreciated.
Hi The_End.
If all works as it should the majority of any PPI monies reclaimed should actually go to your creditors.
So long as you signed your trust deed after April 2008 your trustee can discharge you and remain in office themselves to handle the PPI claims.
Thank you very much. That is helpful and gives me piece of mind. They are welcome to my ppi through my creditors, I just didn't want them to hassle me for further money. Can I chase ppi through other credit I have had in the past that wasn't part of my TD?
Morning,
Would you believe that's me just received my discharge letter?!? It states that I am legally discharged although my trustee will remain in office in order to claim ppi.
So, just to confirm...can I now chase ppi through other forms of loans/credit outwith that which was included in my TD? Two of the ppi I wish to pursue are loans I had some ten years ago but they happen to be through of my creditors currently in my TD. The TD debt with them is for credit card debt, not loans I had Ten years ago. Is it still ok to pursue them for loan ppi?
Congratulations on your official discharge The_End.
I cannot see any reason for you not to make claims, though there does some to be some scope for things to get messed up if the creditors mentioned alert your trustee to other claims that you might have (as well as the ones linked to accounts which were in your trust deed).
So, what could my TD do to me if they are alerted to me making additional claims? Legally, where do I stand?
I don't think there's a problem for you The_End presuming that you have given your trustee all of the information that they asked for (which I'm sure that you have).
The possible problem is whether a creditor makes your trust deed firm aware that there are other potential PPI claims over and above those that your trustee has initiated. If that happened you may find funds being directed to your trust deed rather than you.
As these creditors are also aware of your trust deed (and that your trustee remains in office) they may also be inclined to send payments to your trustee rather than you.
