Understood TDA . However yet again the only time I hear from this company is when they wish to draw fees or issue threatning letters .

Amazed no one has /had dealings with this firm , maybe all the fees I [:p] have paid have been invested for me rather than paying a non exsistant trustee / firm !!.

As for fees. If they are excessive I believe individual debtors under a Trust Deed have the opportunity to appeal them through the court. Creditors also have a similar right of appeal by all accounts. If no one appealed then the fees can be drawn. Perhaps one of the resident experts can confirm that however?

Another thing to bear in mind is that the fees are perhaps a small price to pay for the amount of debt that is written off as a result.

You are correct that fees perceived to be excessive can be audited. I think it would be the AIB that would do this rather than the court.

I would be glad to hear from persons who have had positive dealings with Begbies Traynor to keep a balanced view of things .

In all honesty I have had nothing but negative dealings with this firm , and now nearing year 7 of a trust deed with them .
Have been locking horns with them for nearly a year now and its like talking to the void to get them to provide proof about statements they have made.

I have provided detailed information to prove my point to them , nearly seven years of stress and worry and illness because of this is no peace of mind for writing off any debt .
As far I can prove my discharge should have been nearly four years ago , as I paid what was due within a matter of months of starting the deed .
Since then I been threatned with eviction from my home and more money being paid into the deed which has been eaten up by fees .

Moving towards making a formal compaint to the law society and ICAS to get this matter sorted out once and for all , never did I think seven years on that this situation would have caused me so many sleepless nights and the cause of many arguements and a huge contribution to my marriage break up ,all because I took positive steps to become debt free and meet my obligations and pay into the deed for the benefit of my creditors .[:(]

I have had TD since 2007 with Begbies Traynor Pinalta and I am still awaiting Discharge. For some reason they need to claim money back from HM Customs and Excise this is after the PPI fiasco I don,t think they are ever going to discharge me !!!!!! also I think if you signed in 2007 Its harder to get a Discharge for some reason.

The customs and PPI side of things are problems which are quite recent as far as I am aware , hopefully the experts could expand on this .
I know there are certain regulations which apply to deeds taken out at different times but I am no expert so cant offer up more thoughts on that . Though I think you can be discharged but the trustee can remain in office to follow up PPI claims etc , but not sure at what point this is able to be done it depends on when you took out the deed .
Its a sore point with me as I thought I would be discharged after three years if I paid over the half share of equity in my property .

Seven , years on and no discharge hoping when this is sorted out once and for all the Trustee's fees will be re- audited and excess funds taken from me will be paid back with interest . Out of interest who is your trustee ?? , I put a open post a while back asking my trustee/ Begbies to comment on my situation but they chose not to reply but that was their choice . I bet I can guess who your trustee is though !!!!!.[:0]

Hello lissybladey.

There has been a general issue with VAT and trust deeds. VAT used to be charged on these services, but then it was determined that it should not be. Trust deed providers have had a complex task working out exactly how to account for this.

With newer trust deeds there isn't an issue for the client as they can be discharged and work can continue on the VAT issue. Sadly the rules were different when your trust deed was signed and this option isn't open to them.

This has been a general issue for the industry rather than being restricted to a small number of firms.
