DAS/Selling Home/Inhibitions

I have been repaying my debts via an approved DAS (approved in Nov '09).

My house has enough equity to repay my debts but at the time I could not access the money due to the financial climate. I now have a mortgage offer Approved in Principal and wish to take advantage of this to repay my debts.

2 of my creditors had Charges for Payments granted by the Court and subsequently applied Inhibition Orders to me preventing the sale of any property.

I have contacted both via my solicitor to enquire about the removal of the inhibition and both have responded that they will seek payment in full including interest before they will remove the Inhibitions.

Is there any way I can challenge this as I believe that this is an abuse of the DAS Legislation.

Hopefully our resident DAS Approved Money Adviser, George White, will be able to provide some useful information when he nexts visits the forum.

Hello billybraggtastic.
In matters relating to an existing DAS it is best to contact the DAS approved money adviser who set up the case in the first place.
The money adviser will be in the position to put forward a variance to the DAS Administrator requesting repayment of all your debts by means of your mortgage advance. The money adviser is responsible for your ongoing administration of your DAS and will be in a good position to speak to the 2 creditors who have raised inhibitions to have that issue resolved.
