creditors havent made claims - excess payments

Hiya,

looking for a bit advice. we were discharged in Oct 2014. The Trustee is now writing to creditors to settle the account. My husband and I have separate trust deeds started at the same time.

My husband has paid circa £13K, the trustee wants £5.5K , and the only creditor so far to put in a claim is £4K.

this leaves £3,800 sitting. what happens to it? does it go toward my trust deed? do we get it back?[:)]

Hi tinsoldier, that's right. Investigating PPI apparently.

I have been told numerous times that they were almost there. I threatened them with a formal complaint and two weeks later they have sent the statement showing what the creditors have claimed.

Hi LisaJane.

It's quite possible other lenders will submit claims.

However, in theory, money could come back to your husband if insufficient claims were made versus the funds paid into a trust deed.

Interest might be added to the creditor(s) that have submitted a claim though, which might diminish any refund.

Hi Amy,

Thanks for the response, the creditor who has put in a Claim (HMRC) has submitted a request for interest of £1.5K which seems high on 4K.

I expect other creditors will come out the woodwork, but fingers crossed never the less #128521;
