Hi my trust deed is protected i received a call yesterday from a door step collection agency about a debt to a pay day loan company i had not heard from this in over a year so had no paper work to give to my ip so was not including in my trust deed they said i then still have to pay the debt is this correct as there a probably still more as well seen to be coming out of the woodwork now that they can see im in a trust deed

Hi Marieh38.

If the debt existed on the date that you signed your trust deed it is included.

You should let your trustee know about it, and also let them know about any other debts you're aware of even if you haven't got all of the details.

You should not make any payments directly to this lender if the debt existed at the time the trust deed was signed.

Hi Marieh38,

All debts which existed at the point you entered into the Trust Deed is included so you don't need to worry about anyone coming out the woodwork now and trying to pursue you.

The Trust Deed used to be advertised in the Edinburgh Gazette to try and avoid the situation where a creditor may say they didn't receive paperwork so are not agreeing to the Trust Deed. It's fairly common for creditors to say they haven't received any paperwork and continue to try and pursue you for the balance.

With our clients if they are in any doubt about their debts or if they think they may have forgotten about 1 or 2 we can carry out an Experian search free of charge to make sure we find out about everyone we can.

Speak with your Trustee and advise them about the debt collection company. Pass on their details and let your Trustee contact them.
