Hi all,

I have one creditor still showing on my credit file and owing them money after being discharged for my trust deed for over a year. I gave them a call and they are saying they don't need to update my credit file, they will just stop actively looking for the money? Can they do this?

Hi Stuh88.

They're wrong!

See the following article, which outlines creditor responsibilities to reflect reality when they report about you to the credit reference agencies:

https://www.trust-deed.co.uk/repair-your-credit-rating.html

I'd suggest making a formal complaint to them about:
1 - Failing to update your record to reflect the reality that no money is due to them.
2 - Providing you with false information.

Once their complaint process has concluded, if you remain unhappy you can take the matter to the Financial Ombudsman to resolve for you.

The information held is part of financial product and it is data the data regulator in the UK is the ICO.

I used them for an issue I had and they upheld my complaint and awarded compensation. The FSO told me that they could help with disputes about payments and products but referred me to the ICO who investigated the data element of it.

you might also want to raise a concern wit the ICO if they do not correct within 28 day of your request.
