Hey all, looking to see if someone can clear something up for me, I was sequestrated in December last year so obviously will not be discharged until this December. Since then I have managed to get all my creditors that were registering defaults on my credit file to update them to being satisfied which has been done normally with only one or two phone calls to each company,

all apart from Lowell who have two defaults showing on my report, I've spoken to them every 4 weeks since my bankruptcy was awarded and kept being told they would amend it within 4 weeks, having phoned them today they are now sayin they won't be amending it until at least when I have been discharged and that they don't need to backdate the date to when I was declared bankrupt,

I find this strange considering every other creditor has amended my credit report without any problems yet Lowell seem to be adamant they are not going to help, are they correct in what they are saying that they can keep reporting it monthly as a default? In my eyes if they keep doing that then that implies I still owe them that money when I thought that the debt was written off on the day bankruptcy was awarded.

If anyone can clarify what the normal procedure is then that would be great...

Hi davy1601.

None of us here are experts on credit files.

I suspect they should backdate any default notice to no later than the bankruptcy date though.

Lowell are a nightmare. I managed to get all my creditors to update my credit files to reflect the correct (or near enough) default date and the status (settled or partially settled).

A few I had to go to the Information Commission Officer (ICO) and complain about last summer. One of these was Lowell. The others that I complained to the ICO about all updated my files within a month or two.

I received an update of my credit files last week and lo and behold, the entry on my file from Lowell hasn't been updated. The ICO told me that Lowell had responded to them that they would update my file. The last update date on that entry in my credit file is before I complained to the ICO.

So they have done nothing in about 6 months. I have raised it with the ICO again and am awaiting their feedback. About time firms such as these started to be fined for such flagrant abuse of the credit file system.

Hi davy1601,

Well done on being proactive in speaking with the creditors and asking them to accurately reflect the current position on your credit file.

It sounds from what mapleleaf has advised that you may need to consider a formal complaint to Lowell and if that fails then you could go down the route of a complaint to the ICO.

If you do take it further let us know how you get on as information like this is valuable for other forum users and I also find it useful.
