Closure / Discharge from Creditfix

As a previous client of PJG . I completed all of my PPI
Forms at the very beginning of my trust deed with PJG.

I am at last near the end -
4 years trust deed
6 months equity

My final payment due at the end of this month.

I received an email from Allay saying they would
Soon be in touch to check my PPI.

Can I please ask the experts here whether this is correct.
I phoned Creditfix and was told that this has to happen
Even if it has been done before.
I said I didn't agree.

My concern is
1- it has been done and they should have a record of this

2- it will /. Or is intended to slow the closure down

I was told it is part of my contract

( as a transferred customer - I had no such

Contract ) I was transferred without knowledge

I was also told it will have no impact on the closure which I feel may not be correct

Hi ann910.

You may have signed PPI forms initially, but do you know if a PPI investigation actually took place (usually with the assistance of a claims firm) and was completed before your transfer?

It seems that your new trustee would usually have every right (and a duty) to ensure that any PPI claims that are viable have been fully completed.

You can be discharged while this work takes place.

I'd imagine the "contract" referred to is your trust deed, which can be, and sometimes are for all types of reasons, transferred to a new trustee.

Thanks for your reply.

My main concern was that it would hold up my discharge. I didn't know I could be discharged with that on-going.

I completed the PPI forms but was not informed if there had been an investigation.

I remember being told that the PPI would be investigated at the beginning so that closure was NOT held up

It really doesn't need to hold up your discharge ann910.

You complete your obligations - your trustee can discharge you.

Your trustee deals with the PPI and other work they'll still have to do and then seek their discharge once finished.

I think this perhaps is why you were informed that this doesn't have implications for the timing of your discharge.

Objecting to all of this certainly might have negative consequences for the timing of your discharge, or worse eventually if it isn't then resolved.

Thanks for the information.

I didn't know I could be discharged with that ongoing as I said.

I therefore made the wrong assumption.

I was just under the impression it had been done.

I would therefore have no objection.

I had the same email from creditfix, slightly different situation than you ann910 in that my last payment was June and have received my form 5 in July/August. Am I still obligated to go through the ppi process with allay claims TDA?

I don't know whether you could be compelled to Worried_dad.

Hopefully someone else could share their thoughts here about whether your prior discharge changes the position.

Can I ask one more question

I was told that allay could continue to investigate for some time which was one of the reasons I thought it might hold things up.

But just wondering what that means.

Do they keep you on file?

Do they do it more than once?

Or is it investigated fully and closed ?

With all the posts about PPI and re-opening cases - could they investigate in future years?

Ok, thanks. I have sent them an email asking the question, haven't heard back yet so might have to phone them and find out as I've already had 1 missed call from allay claims and creditfix aren't usually that quick at responding.
It just seems silly that they've had 18 months or so whilst I was in the trust deed to do this and then wait until a matter of months after my form 5 to initiate it.

Hi ann910.

The trustee will simply be looking to confirm that there's no PPI assets that they have a duty to collect in for your creditors.

After that I'm sure they'll look to get discharged.

They'd then have no scope to do anything much in connection with your case, unless a court agreed to them being reappointed for some reason.

It might just be a simple admin mistake. To be fair, they're only looking to do what they'll do for all clients and which they're also professionally obligated to do.
