i went into sequestration a wee while ago and fell behind on payments due 2 going thru a hard time loseing a family member and is wondering how relaxed yous are on lowering payments amouts etc i pay 25 a week and will have to pay my 70 montly payment to whice im gona struugle with because of increase csa payments 2 things r just gettin on top of me again [:(]

Welcome to the forum bobmann29.

Your payment under sequestration is based upon affordability. If you can verify that your CSA costs have increased your trustee may consider reducing your payment.

okay thank u i will get csa 2 send out the evidence of that and fax it asap il call them monday,so if i tell my truste i can only afford 50 on monday he will have 2 accept that???

Not quite.

If the calculation of your income and expenditure, as amended by a revised CSA payment, demonstrates that this is the affordable amount now its likely to be adjusted.

Hi bobmann29,

As TDA has said, it should all be based on affordability. Sequestration shouldn't put pressure on you and make you feel like things are getting on top of you again.

Give your Trustee a call and explain the increases in your expenditure and ask them to send you out a current status report. If you can fill this out and send it back or even work through it with them over the phone and it shows that affordability wise they need to reduce your payments then I would be surprised if they were not willing to look at a reduction in your payment. Sending in evidence of increases in expenditure will also help.
